What you need to know about the new public sector procurement legislation?

Both the Procurement Act (2023) and The Health Care Services (Provider Selection Regime) Regulations 2023 are now in force across England, Wales and Norther Ireland. This is the biggest change to Public Procurement Law for the NHS in a generation. The scale and breadth of change should not be underestimated and will require new governance, processes, and information systems together with a transformation to ways of working across the whole organisation, not just within the Procurement Function / Legal Department. The Provider Selection Regime specifically requires significantly more governance and internal control.

With far greater flexibility and the scope for direct award of health care services contracts, this new legislation is also a huge opportunity for better buying. Procurement is not just about cost control. Sound governance and a strategic approach to procurement can deliver vast benefits.
