Both the Procurement Act (2023) and The Health Care Services (Provider Selection Regime) Regulations 2023 are now in force across England, Wales and Norther Ireland.
This is the biggest change to Public Procurement Law for the NHS in a generation. The scale and breadth of change should not be underestimated and will require new governance, processes, and information systems together with a transformation to ways of working across the whole organisation, not just within the Procurement Function / Legal Department. The Provider Selection Regime specifically requires significantly more governance and internal control.
